Marketplace terms

These terms keep the marketplace useful and safe. By creating an account, listing or messaging, you agree to them.

Who may use the service

You must be at least 18, provide accurate account information and use only your own account. Keep access to your account secure and tell us promptly if you suspect unauthorised use.

Our role

BuySwapAndSell provides search, listings and private messaging. We are not the buyer, seller, auctioneer, payment provider, delivery service or escrow agent. Buyers and sellers decide whether and how to transact. The platform does not collect public comments or handle money.

Listings and conduct

Listings must be accurate, lawful, genuinely available and use photos you are entitled to upload. Do not list prohibited, recalled, counterfeit, stolen, unsafe or regulated items contrary to law. Do not spam, impersonate, harass, manipulate reputation, scrape the service or evade a suspension.

Consumer rights

Private sales and sales by businesses may have different legal consequences. If a seller acts in trade or commerce, Australian Consumer Law obligations may apply. Nothing in these terms excludes consumer guarantees or other rights that cannot lawfully be excluded.

Safety, moderation and reputation

We may remove or feature listings, review reports, restrict messaging, reject verification, suspend accounts and preserve evidence when reasonably necessary to protect users or the service. Sellers must identify a buyer truthfully when completing a marketplace sale. Transaction feedback must reflect a genuine trade and remains confidential. Automated reputation uses marketplace activity and safety signals; it is not a guarantee of identity, honesty, condition or transaction outcome. You may request human review.

Liability and availability

Use reasonable care and inspect items before paying. To the extent permitted by law, we are not responsible for user content, private transactions, missed opportunities or indirect loss. We do not promise uninterrupted availability, but nothing limits liability that cannot lawfully be limited.

Changes and governing law

We may update these terms with reasonable notice for material changes. Victorian law and applicable Commonwealth law govern these terms. Courts in Victoria have non-exclusive jurisdiction.
